Terms

How we work.
In writing.

The short version: a written quote, then a short service agreement with the invoice; one fee, paid up front; thirty days to change your mind and get all of it back; the work is yours when it is done; and if what we built breaks, we fix it free, forever.

01

How a project starts

Every project starts with a written quote: what is being built, what is included, what it costs, and roughly how long it takes. The quote is an offer, not the contract.

When you confirm, we send a short service agreement with the invoice. It carries these terms plus the specifics of your project — scope, deliverables, timeline, and the revision rounds included. Paying the invoice accepts it, and from then on the agreement is the record of what we owe each other. Anything not in it is not in the project — which is not a trick, it is how we keep the price fixed.

Prices are in Canadian dollars. Any applicable tax is shown on the quote and the invoice, not added afterwards.

02

Payment

Packages and one-off projects are paid in full when you confirm the project — the invoice comes with the service agreement, and paying it is what starts the clock. Work starts once payment has cleared. There is no deposit and no balance to chase at launch — one fee, one time.

After-launch plans (hosting, or hosting plus a monthly allowance of changes) are billed monthly, in advance. You can cancel any plan at any time; it runs to the end of the month you have paid for, and your site goes with you.

03

30-day money-back guarantee

If you are not happy, for any reason, tell us within 30 days of payment and we refund the full project fee. No forms, no negotiation.

Three things follow from a refund, and we want them to be no surprise:

  • The work comes down and stays ours — refunded work is not licensed for use.
  • Costs we paid to third parties on your behalf (a domain, a stock photo licence, a plugin) are not refundable, and are always listed in the agreement before we buy them.
  • Monthly plans are outside the guarantee — they simply cancel, as above.

The 30 days run from the date of payment, including any time the project is paused (see below). The guarantee that applies to your project is the one on this page when you paid.

04

Scope and revisions

Each package includes a set number of revision rounds. A round is you sending all your feedback on a stage at once, and us acting on it — not an open-ended thread.

  • Live in 48 hours — one round.
  • Menu & Ordering Site and Business Website — two rounds.
  • Custom and platform work — as set out in the agreement.

Further rounds, or changes to what was agreed, are quoted before we do them — usually a fixed add-on, sometimes a revised quote if the scope has genuinely moved.

Fixing something we built that is broken is never a revision. That is covered by the warranty, below, and it is free.

05

Your part, and what happens if it stalls

Most projects need things from you: copy, photos, a menu or product list, logins to existing accounts. We tell you exactly what and when in the first session. Projects that stall almost always stall here, so this is the one rule with dates on it:

  • If we are waiting on you, we check in twice.
  • After 14 days without a reply, the project is paused. Nothing is lost; it just stops.
  • After 30 days, it is archived. Picking it up again means re-scoping it, because the work and the calendar have moved on.

A pause does not stop the guarantee clock — the 30 days still count from payment.

06

Ownership

When the project is delivered, everything we made for it is yours: the code, the design files, the content, the domain and the hosting accounts, all in your name. You can leave at any time and take the lot. There is no platform you are tied to and nothing we hold back.

Two exceptions. Third-party material — fonts, stock imagery, libraries — stays under its own licence, which we choose so it travels with you. And we may show the finished work in our own portfolio and case studies; if you would rather we did not, say so and we won't.

07

Warranty and after launch

If something we built breaks, we fix it. No time limit, no invoice, whether or not you are on a plan. This covers defects in our work — a form that stops sending, a page that errors, a layout that breaks — not new features, content changes, or things that break because a third-party service changed under them (those we will still quote quickly).

After launch you can leave the site with us on a monthly plan, or host it yourself. The plans and what they include are on the Services page.

08

Privacy

This site sets no cookies of its own and runs no advertising or analytics trackers. Our host, Vercel, keeps standard server logs (such as IP address and pages requested) to run the site and keep it secure.

When you use the contact form, what you type — your name, email address, business and message — is sent as an email to our inbox through Resend, an email delivery service in the United States, and kept as ordinary correspondence. We use it to reply to you and for nothing else. It is not added to a mailing list, and it is not shared or sold.

The full policy — what is collected, who handles it, how long it is kept and how to ask for it to be removed — is on the privacy page.

To see what we hold about you or have it deleted, email hello@dataflair.ca.

09

The rest

We do the work with care and skill, but we cannot promise business results — how many orders a site brings in depends on far more than the site. Our liability for any project is limited to the fee you paid for it.

These terms are governed by the laws of Ontario, Canada. We may update this page for new projects; the version in force when you paid is the one that applies to you.
